The Ely Shoshone Tribe has placed a high priority on keeping its communities and people safe.

On May 17, 2007, The Ely Shoshone Tribe Council adopted by Resolution #2007-EST-20, Sex Offender Registration Code and added to Ely Shoshone Tribal Code 179D, Criminal Offenses, in the Ely Shoshone Tribe Law and Order Code of 2007. Therefore, Ordinance 179D, Sex Offender Registration and Notification Law became effective on June 8, 2010.

In accordance with Ordinance 179D of the Ely Shoshone Tribe Law and Order Code, Sex Offenders are required to register or update their existing records with the Ely Shoshone Tribe Police Department (ESTPD) immediately if currently within or residing here; and within 48 hours of any other reason for being within our jurisdiction even if there is no intention to remain or reside here.

Visiting offenders must register immediately within 48 hours of entering the lands by showing up in person to the Ely Shoshone Tribal Police Department (ESTPD).

Offenders who are required to register Tier I shall also show up in person annually for a period of 15 years, Tier II very 180 days for a period of 25 years, Tier III every 90 days for the remainder of their LIFE.

If strict criteria are met with juvenile cases, there is a clean record provision for juvenile’s to reduce their registration period after 25 years.

Sex Offenders must register immediately with the Ely Shoshone Tribe Police Department (ESTPD). Failure to register or failure to keep information current and updated is a violation that carries a penalty of up to one year confinement in the TRIBAL custody. There could be additional penalties in federal court or state court for failure to register depending on the violation(s).

With the passage of our Sex Offender Registration Code, it provides stringent requirements for registration of sexual offenders and notification to the public of the places they intend to or actually reside, work (whether compensated or not), volunteer, attend college or school or any vocation, and travel. The requirements apply to anyone convicted of covered sexual offenses in any court of conviction, including certain foreign countries and military offenses. This law is retroactive.

TIERING is not a risk level. It is a category designed by the Department of Justice SMART Office which measures the duration and frequency of offender registration and check in appointments. All offenders are TIERED that are registered within this jurisdiction.

The Ely Shoshone Tribal Law requires registration of certain adjudicated delinquent juveniles of serious sexual offenses and the juvenile was age 14 or older at the commission of the offense; OR those convicted as adults of any covered sexual offense. Any sexual offender who has not yet registered or who has not kept their registration information correct and current must do so immediately. ESTPD will pursue arrest warrants for all offenders who have not registered or brought their registration current. Failure to comply with the Tribal Law is also a serious violation of federal law that can result in federal incarceration for up to ten (10) years.

Any person who uses information obtained by a sex offender registry to harm, harass, annoy, or commit criminal violations against a registrant will be subject to criminal and/or civil penalties. Any such activity should be immediately reported to the local police department.
